John Doe v. Saint Anselm College, Case No. 1:2015cv00455

John Doe v. Saint Anselm College, Case No. 1:2015cv00455

On Sept. 1, 2014, John Doe led Jane Roe back to his apartment to hangout. Their conversation and interaction became more intimate and the two consented to going upstairs to Doe’s room and engaging in sexual activity. After the consensual sex, Doe walked Roe back to her room. The following day, the two shared a congenial text conversation. Soon enough, Doe was immediately expelled whence an investigative panel ruled Doe guilty on claims of sexual assault against Roe. Roe sued the school on the grounds of “procedural errors regarding the nature of the investigation, his right to the information necessary to accurately defend himself, the questionable compositions of the panel, lack of training of the panel members, and new evidence available to him after the hearing, Ms. Shuster rendered the decision to deny his appeal, effectively “rubber stamping” the decision of the panel.”

Attorney: Andrew T. Miltenberg  Nesenoff & Miltenberg, LLP.
