A judge overturned the expulsion of Corey Mock—a University of Tennessee at Chattanooga student and star wrestler—after determining that UTC’s administration had improperly required Mock to prove that he was innocent of sexually assaulting another student.

On Aug. 29, 2008, John Doe and Jane Roe engaged in consensual sexual intercourse. Roe stayed the night at Doe’s place and solemnly left his room in the morning to report that Doe raped her the previous night. A look into Roe’s medical history reveals a troubling depression, narcolepsy and anxiety. Although there was no preponderance of evidence to support Roe’s claim, the university expelled Doe. Doe sued the university on counts of due process violations and was awarded a mere $26,500, a refund for tuition dues.
